| As with any other site that deals with real money, ShiftingImages also has some Terms of Service. Basically, they protect myself and the domain from being sued from 3rd parties, plus they protect you by laying out what you can and cannot do.
The Terms of Service (TOS) may change at any time and without notice nor liability to you. It is YOUR responsibility to be sure you are up-to-date with the TOS. If you disagree with anything written here, please exit the site and discontinue use of all features provided.
ShiftingImages.com (hereafter referred to as 'SI') provides members (also referred to as 'users', 'you') with an image-hosting service on an as-is basis. SI provides no guarantee there won't be downtimes nor that it will not damage your computer. If such a thing happens, you agree to release SI from all charges and responsibility associated with such problems.
SI does not issue refunds.
SI reserves the right to delete Trial Subscription accounts that have not been used in 45 days or more. SI reserves the right to delete images in Trial Subscription accounts that have not been used in 45 days or more.
Upgraded accounts (non-Trial Subscription accounts) that are not renewed shall be downgraded. All images in accounts that are being downgraded are deleted at this time.
SI reserves the right to alter account privileges at any time, including, but not limited to: bandwidth limits and access limits.
SI reserves the right to be sold, as a whole, to another third-party, including all user information stored in the database. SI reserves the right to shutdown completely at any time and without notice nor guarantee the site will be back up.
You agree to not hold SI liable for the release of private information in the event a 'hacker' compromises the server. You agree that SI has permission to release all known information about you to government departments, such as the FBI and police, in the event that they should require such information.
By using SI, you will only upload images that are designated as 'OK' by SI. No pornographic, illegal, racist, sexist, etc. content will be allowed on the site. By allowing such content into your account, your account will indefinitely be permanently shutdown and the proper authorities contacted. SI is not obligated to monitor user accounts for such content.
You agree to not use SI to upload anything but images that YOU own the copyright to, or have permission to use. You agree to release SI from liability arising out of your use of the site. You agree to defend SI against any such issues arising. In addition, you are responsible for your account, passwords, content, and all activities on your account on SI. If a third-party retrieves your password, be sure to change it as soon as possible; you are responsible for anything that third-party may have done on your account.

Your account is a privilege, not a right. Your account can be eliminated at any time for any reason as seen fit by SI.
Users may have one account per person. Using more than 1 account breaches the TOS and will force SI to delete all of your accounts. Creating a new account once you have been banned is strictly forbidden. All accounts are limited to the storage limitations related to their account level. SI reserves the right to prevent direct-linking on accounts that are using excessive bandwidth or otherwise abusing the service. SI reserves the right to change any such limitations, prices, etc. without notice to the user.
All members of SI must be at least 13 years of age. No personal information is knowingly collected from persons under the age of 13 years; if any personal information is found to be collected from children under the age of 13, SI will delete the information.
These Terms of Service constitute the entire agreement between the you, the user, and ShiftingImages.com with respect to the subject matter contained herein and supersedes any other agreement, proposals and communications, written or oral, between SI and you with respect to the subject matter hereof, except that any other terms and conditions located on any individual site associated with SI are incorporated herein by this reference to the extent they do not conflict with these Terms of Service. If a court should find that one or more rights or provisions contained in these Terms of Service are invalid, you agree that the remainder of the Terms of Service shall be enforceable.
